Hmmm. That’s a good point. I think email would be protected though as it’s always considered private communication. I guess the only problem would be if the email message went through a public group, in which case one would still do due diligence regarding the investor’s suitability.

The article also correctly points out that the investor would have to sue their own investment in order to get any damages – most unlikely.

Such arcane problems are good to have IMHO.

Thanks for the Yipit mention, Adam. I actually got the idea after seeing an elevator pitch on Techcrunch about a company called WrapMail that does this: http://bit.ly/bkMH (though I think WrapMail goes a little too far with the advertising)
